    San Antonio Ferrari totalled a client Ferrari.

    Rather than admit the wreck, the dealer who had the car on sonsignment, attempted to get the owner to take a below market price.

    Apparently the dealership hoped to close the deal and then collect dealer insurance. But the owners saw the 'buyer' was the dealer.

     

    A lawsuit is underway.

    As I say, I never run out of new material for our fraud chapters in audit and ethics class..

    Citing a desire to strike the right balance between rigorous academics and students’ stress levels, North East Independent School District trustees voted Monday night to end calculating class rank for students below the top 10 percent. The policy will take effect when the district’s current class of seventh graders enters high school.

    “It is really important we have just the right tension on social-emotional learning when we think about rank,” said Colleen Bohrmann, NEISD’s executive director of Learning Support Services, at a December meeting. “We want to be sure that we are pushing the students to a rigorous coursework, but when is it too much?”

    With no discussion and no district residents speaking on the matter, trustees unanimously approved the second and final reading of the policy Monday night. The approved changes to the policy can be viewed here in red.

    Apparently the right tension is not tension!  If you are now in the  89th percentile, what will be the incentive to work or try if an observer cannot distinguish you from the one percentile, ie bottom of the class?

    And here is a comment from a Chief Academic Officer

    “We’ve found over time that labeling all students with an exact rank feeds a culture of unhealthy competition, stress, and pressure,” Katy ISD Chief Academic Officer Christine Caskey told the Houston Chronicle at the time of the policy change.

    There’s no one rule that mandates how class rank should be calculated in Texas, Hardcastle told trustees. This often leads to districts calculating grade point averages and rank differently, he add

    Well if it's good for the goose, how about the gander?  If this is a good idea in class, can it be long  before say Clemson wants the same deal given its loss to LSU?  No doubt that was a as you put it ' culture of unheallthy competiition' and on national tv no less, how embarrassing, what a blow to self esteem!

    Oh and now that one thru 89 percent is the same percent, what does the Chief Academic Officer do all day I wonder, well there is that pesky ten percent to worry about but gee surely they are not in need of much help, but someone does need to calculate that in  fact they are tenth and not eleventh.

    As I recall TAMUSA admits the top 25% with no questions asked, hm how are we to measure the lost 15 percentile I wonder?

    The Fibonacci number series is such athat as one adds the numbers, each preceding number is 6..8% of the next number.

    3+5=8

    5/8= 6.25%

     

    the smaller numbers are close as the number series progresses, the ratio becomes tighter

    The Republicans made a huge mistake in attempting to 'impeach' Bill Clinton when they did not have the votes.

    It would be only a matter of time until the power shifted and sure enough, the Dems want to impeach  Trump, without having the votes.

    Now a Congressman suggests that if Biden wins, we already have the forms to impeach him.

    Louie Gohmert a former Dist Judge and Aggie Corps member, says he is worried for the country. I agree,  now that impeachment has been lowered to the level of a traffic ticket,  do we have I don't like this guy or gal, let's tart iimpeachment inquiry with the hope we can ruin his or her reputation without ever actually proving anything.

    Negative mood abounds.

    I wrote this column before the jobs reort, 266,000 + created, came  out. Stocks moved up 1.2%, sooner than I anticipated.

    All Quiet on the Energy and Stock Front

     

    Saudi Arabia prices its1 .5.% IPO of Aramco at $8.53 or a total of $25.6 billion, the largest IPO ever.

     

    Vienna, Italy The proposed cuts would mean OPEC would hold back 1.7 million barrels per day MBPD, deepening the current1..2 MBPD.

    Do the algebra and that means ARAMCO is worth $1.7 trillion, but only if oil prices stay above $55 per barrel. Most sources I read put break even for many oil producers in the mid 50s range.

     

    Such an IPO befits the social mood of an expanding market. Letting the world in on the great Saudi money machine is an inclusionary move. Positive social mood is brings people together and nothing accomplishes that better than the largest IPO ever. Even attempting to calculate which of the world’s exchanges to list on was a challenge. Note the markets continue up despite the partisan impeachment process and round the world work stoppages and protests in France, Hong Kong, Moscow, and now sprouting in various South American countries.

     

    I have been looking for a low in energy share prices in this time frame.   The actual low occurred in mid-August, a higher low in October and now a third low in early December.   This is happening along with a pause in the rise in Industrials, Transports, ad the tech heavy NASD.

     

    He moving averages have yet to turn up for the Energy ETF XLE.   Cash strapped Exxon Mobil trades under all its our Moving Averages MA.   Much better managed Conoco Phillips has vaulted over those same four Mas.   The MAS on Chevron CVX ae converging which suggests a change in trend, probably to the upside.

     

    There are signs that energy service may finally be bottoming.   Schlumberger SLB is about to attack its 200 day MA.   Halliburton is in much the same position.   More patience will be needed ffor Patterson PTEN which has risen from its August low.

     

    Chairman Greehey purchased $15 M of Nustar NS shares. And it is in a nice uptrend. The ETF of that group, Alerian MLP AMLP is perhaps making a low. This process is taking longer given the correction in the overall stock market.

     

    The uber negative news on natural gas resulted in a bit of rally. It has duplicated the rise of oil with lows in August, October, and now early December.   Devon DVN needs a close over 24 to indicate an uptrend has resumed.

     

    The most reliable New York Stock Exchange Advance Decline Line is continuing to risep. Year-end tax selling has the major averages on hold. Expect this to continue until later say December 15-20. Then expect a Santa rally extending well into January.

     

    A continued stock rally coupled with thee energy market improvement is about as good as we can expect from Santa this year.

    Note one of the two had only been open this  year.

    It is amazing that San Antonio has so many good CPA firms who might have helped prevent this but apparently he was on his own. The article does not indicate if he had an outsside financial advisor.

    Restaurants do not go out of business because they do not know how to cook. It is the lack of financial management.

    Finally a race themed movie with a real plot. Except this is not just any plot,

    Ford versus Ferrari

    features wonderful larger than life but real life characters that played out this famous battle for racing supremacy.

    From a socionmics standpoint, it is inevitable this would ahppen in 1966, the first ever flirtation  of the DJIA with the never before seen level of 1.000.  As Iococca puts it in the movie, baby boomers don't want to drive Dad's car. Hence the Mustang was created.

    Ford attempted to buy Ferrari but was rebuffed. And as Lee put it, that was just a show to get a bailout from FIAT, which is what happened.  Alerted to Ferrari's actual reacction and description of Ford, he replies, I  want to win, I don't care what it costs.  I would be hard to create a better line up of characters

    Carroll Shelby – winner of LeMans in  1959 and car builder himself

    Ken Miles – creator of the Cobra and made the GT 40 a real winner

    The cast at Ford including Henry  and Bebee, both as arrogant as can  be, or as Enzo Ferrari put it, he is Ford II not Ford I

    Enzo Ferrari – as Shelby put it in his eulogy to Enzo, the only guy who ever got to run his very own car company

    We know nothing of the marriages of all the other men, but we learn a great deal about the family of Ken MIles, Mollie and son Peter. Mollie is very well played by Caitriona Balfe. I suspect this is to attract the wives and girl friends of guys likely to attend the movie themselves.

    Yes go see this one at the theater, the Lucas Dolby sound alone is worth the admission. And the race scenes are great. Dozens of digital artists are in the credits as I am sure they could never find this many of the original cars.

    The problem with the other big three race movies that come to mind

    Winning with Paul ewman

    Le Mans with Steve McQueen

    Grand Prix with James Garner

    is the lack of plot and character development, particularly in LeMans.Here the characters are everything, the cars are the props.

    High Noon was the first western to win an Oscar for Best Picture. The reason was that it featured a real theme of Civil Obedience and real characters who reflected just that.  One by one the town deserts Sheriff Will Kane who tries to raise a posse at different locales. .Finally left alone, we see Kane hand write his last will and testament.

    l wished for more technical detail but there is a good deal of that, particularly regarding the replacement brakes.

    IMDB estimates the budget at $97 M and I do not doubt that.It has already grossed $62 M.

    It rates a 8.3 on IMDB which is really really high.I quite agree.

    Pick an early matinee,  we went to the Huebner Oaks which has the best theater seats I have ever experienced.
