joseph Scott flew his airplane into an IRS office in a seething fit of rage. But the reality here is that many people are not 'wired' to face the reality of paying their own tax bill. If witholding were repealed, the entire US Government would not last six months.  Scott was apparently a tax protestor and had been in trouble with the IRS before. He had a failed business or two and the news does not say if he still owed payroll taxes. in one recent year he failed to file a tax return. 

As a professional accountant you should know that most tax problems are of the following varieties, at least this was my experience as a CPA. 

The big issue, a taxpayer knows the tax is due and simply does not pay. This is a particular problem with payroll taxes. Remember that the employer is liable to send in witholding for income tax, social security plus matching, FUTA, SUTA. The IRS knows of course when someone stops paying and should intervene right them but they never do in my experience, Of course the situation only gets worse. Understand that the IRS likes penalty and interest to mount up but usually this just results in an inability to pay.

A second problem is the simple failure to file. Again the statue of limitations does not even begin until the return is filed. And of course there are income returns for partnerships, corporations, and sole proprietors as well as 941 payroll tax returns as well as estate and gift tax returns. 

And the third problem is filing an unrealistic return. The IRS of course has all the stats on what are reasonable deductions for  every kind of allowable expense. If the return exceeds those expectations, like in any audit, the IRS uses analytical procedures to determine likely candidates for audit review.

    Speaking of the tax man when is the IRS going to wake up? There is a temporary tax office on every corner from mid-January to April 15th. They are allowed to partner with a bank and offer refund anticipation loans at interest rates upward of 100%. It is mostly the poor, uneducated who think they need their money today when in reality they could wait another two weeks and receive all their refund from the IRS instead of giving it away to these temporary businesses.

    The Administration wants every tax preparer to ‘register’ with them. I had a tax preparer number as a CPA. Whether they want to crack down on loan sharking or whether they want to make tax preparers virtual govt employees I do not know. But I suspect they will take the position that if very many of your tax clients are audited and owe money, then you are not doing the correct job for your real employer, the govt. At that point I would expect fines or expulsion from the clb. The Govt I believe will take the belief that the preparer works for them not the tax payer.

    My boss a CPA, uses her tax preparer ID on everything that goes out. I understand why she has everything looked at twice before she reviews it and sends it out. She can be held liable for any deviance any of her clients may be trying to provide the IRS. Joseph indeed was in a tight corner he thought he could not escape. I feel bad for the man, seeing the scary IRS letters I see that our clients get, BUT you do prove a point Professor Elam. Being in the field he was and having two businesses he would know that those reports and returns are needed to be filed in the timely manner the IRS states, and what rules apply with those returns. For him not to file one year, and have his own private plane etc. I have to wonder what was he thinking? I want to see the movie “7 Pounds” with Will Smith. I saw a bit of the beginning, he was an IRS agent going to taxpayers homes and place of work to inform and get to the bottom of their tax liabilities. I did not get to see it because of course…I had homework to do!! 🙂
